A Brighter Future on both sides of the Atlantic or Certainty of Uncertainties

Landmark changes have taken place in America with the enactment of the America Invents Act replacing the “first-to-invent” system with a “first-to-file” system as is common to other industrialized states while the European Parliament has approved the EU legislation for a single unitary patent throughout member states (except Italy and Spain) and a single unified patent court system. The incidental changes in substantive and procedural laws and regulations have far-reaching implications. Do they bring about the benefits which the changes are intended for or create more problems to those existing.
With the escalation of inventions and filings originating from Asia, it is important to fine-tune protection strategies in these major markets in light of the changing circumstances for best protection. A clear steer is required to best cope with and benefit from the new systems. Our panel of experts will examine critically the issues and opportunities which the new environment embraces.
